Kejriwal’s conditional bail after many rejections is a legal procedure —

NEW DELHI, September 13, 2024—Delhi Pradesh Congress Committee president Shri Devender Yadav said that Arvind Kejriwal’s conditional bail by the Supreme Court, after many rejections, in the liquor scam case, was a legal procedure, though he cannot go to office and function as  Chief Minister, which exposes his and the character of the  Aam Aadmi Party before the people. He said that people were now looking for change as they want a stable Government which solves their problems, and not a Government in a limbor without a non-functioning Chief Minister.

Shri Devender Yadav said that the SC granting  bail to Kejriwal with stringent conditions  makes it clear that the court has not acquitted him,  though the AAP has been celebrating the bails of Kejriwal, Manish Sisodia, Sanjay Singh and Satyender Jain  as if they have been absolved of all the corruption charges against them. He said that when Kejriwal was granted bail before the Lok Sabha elections, AAP’s Rajya Sabha MP Swati Maliwal was assaulted inside his official residence by his private secretary Bibhav Kumar, and that case is on trial.

Shri Devender Yadav said that Delhi Congress was the first to come out on the streets and object to opening of liquor vends all over the Capital, including non-conforming areas, when the scrapped liquor policy was implemented, and if there was no irregularity in the old liquor policy, why was it scrapped in a hurry when the Lt. Governor ordered a CBI probe into the liquor policy following a complaint filed by the Delhi Congress? And if there was no scam in the scrapped liquor policy, how could the Aam Aadmi Party, which was not even a national party then, generate so much money to contest the Goa Assembly elections and these questions have not yet been answered.

Shri Devender Yadav said that it was ironic that the Aam Aadmi Party has been celebrating the bail of Sanjay Singh, Manish Sisodia and Arvind Kejriwal as if they had returned from a major conquest, forgetting the fact that they continue to face trial for the cases filed by the ED and CBI for money laundering and corruption. He said that the fact that Kejriwal has been granted bail for a  Rs 10 lakh  bond and two sureties, his  passport will remain with the court and he has to report to investigating authorities twice in a week, was shameful for  the Chief Minister of Delhi, whom people had elected thrice to power expecting a transparent and corruption-free Government, but what they got instead was a Government which set a bench mark for corruption, and other criminal activities as 19 of the AAP MLAs had been in and out of jail for  various criminal and corruption cases.

शराब घोटाले में मुख्य आरोपी मुख्यमंत्री अरविन्द केजरीवाल को सुप्रीम कोर्ट से शर्त पर जमानत मिलना न्यायिक प्रक्रिया का हिस्सा है-देवेन्द्र यादव

नई दिल्ली, 13 सितंबर, 2024 – दिल्ली प्रदेश कांग्रेस कमेटी के अध्यक्ष श्री देवेन्द्र यादव ने कहा कि लोकतांत्रिक व्यवस्था में संवैधानिक प्रक्रिया के अंतर्गत शराब घोटाले में मुख्य आरोपी मुख्यमंत्री अरविन्द केजरीवाल को सुप्रीम कोर्ट से जमानत मिलना न्यायिक प्रक्रिया का हिस्सा है। कानून अपना काम कर रहा है और न्यायिक व्यवस्था में सबको विश्वास रखना चाहिए, परंतु जमानत के बाद यह नहीं समझना चाहिए कि मनीष सिसोदिया, संजय सिंह और अब अरविन्द केजरीवाल शराब घोटाले के आरोप से मुक्त हो गए है, मामला अभी भी कोर्ट के संज्ञान में है, उन्हें 21 मार्च को ईडी ने गिरफ्तार किया था।

श्री देवेन्द्र यादव ने कहा कि आम आदमी पार्टी कह रही है कि यह सत्य की जीत है, लेकिन सत्य यह भी है कि कोर्ट ने स्पष्ट कर दिया है कि मुख्यमंत्री के दायित्व का कोई भी काम वे नही कर सकते। उन्होंने कहा कि दिल्ली की जनता के सामने केजरीवाल और उनकी पार्टी का चरित्र उजागर हो चुका है, और जनता दिल्ली में बदलाव चाहती है। जनता के कांग्रेस के प्रति बढ़ते रुझान और हमारे विकास के उदाहरण देने पर स्पष्ट हो रहा है कि जनता विधानसभा चुनाव में कांग्रेस बहुमत में देने को तैयार है। 

श्री देवेन्द्र यादव ने कहा कि अरविन्द केजरीवाल की जमानत पर आम आदमी पार्टी को यह ध्यान में रखना होगा कि केजरीवाल को जमानत उनके मुख्यमत्रीत्व अधिकारों को संकुचित करके शर्तों के आधार पर दी गई है। उन्होंने कहा कि जमानत पर रिहा केजरीवाल अपने ट्रायल को लेकर कोई सार्वजनिक बयान या टिप्पणी नही कर सकते, किसी भी गवाह से किसी तरह की बातचीत नही करेंगे, केजरीवाल अपने मुख्यमंत्री कार्यालय नही जा सकेंगे, न ही सचिवालय जा सकेंगे। सरकारी फाईलों पर हस्ताक्षर नही कर सकेंगे, केस से जुड़ी किसी भी अधिकारिक फाइल तक हस्तक्षेप नही करेंगे और  जांच में सहयोग के साथ जरुरत पड़ने पर ट्रायल कोर्ट में पेश होंगे। 

श्री देवेन्द्र यादव ने कहा कि कानून अपना काम कर रहा है, शराब घोटाले की जांच के अंतर्गत जेल में बंद दिल्ली के मुख्यमंत्री केजरीवाल की जमानत का सुप्रीम कोर्ट का फैसला कानून के अंतर्गत लिया गया है, हम उसका सम्मान करते हैं। उन्होंने कहा कि  दिल्ली कांग्रेस का शुरु से ही स्पष्ट रुख रहा है कि शराब घोटाले में हुए भ्रष्टाचार का मामला हो या दिल्ली सरकार के विभागों में भ्रष्टाचार हो, दोषियों को किसी भी दशा में बख्शा नहीं जाना चाहिए और यदि कोई निर्दोष है तो उसे जेल नहीं होनी चाहिए।

श्री देवेन्द्र यादव ने कहा कि आम आदमी पार्टी के नेताओं द्वारा कट्टर ईमानदार केजरीवाल की गिरफ्तारी को सुप्रीम कोर्ट कोट वैध करार देते हुए कहा कि उनकी गिरफ्तारी सबूतों और भ्रष्टाचार में संलिप्तता के आधार पर हुई। उन्होंने कहा कि कांग्रेस ने सबूतों के साथ शराब घोटाले की सीबीआई में शिकायत की थी और अगर नई आबकारी नीति में कोई त्रुटि नही थी या भ्रष्टाचार नहीं हुआ था तो केजरीवाल जी ने उसे वापस क्यों लिया?

श्री देवेन्द्र यादव ने कहा कि शर्तों पर बेल मिलने के बाद अरविन्द केजरीवाल का पासपोर्ट कोर्ट में जब्त रहेगा और उन्होंने जांच अधिकारी के समक्ष हर सोमवार और वीरवार को अपनी मौजूदगी दर्ज करानी होगी। उन्होंने कहा कि एक मुख्यमंत्री के पद पर रहते के लिए अपने होने का वजूद पेश करना शर्मनाक है। उन्होंने कहा कि दिल्ली वालों के विश्वास को धोखा देने वाले भ्रष्टाचार के आरोपी अरविन्द केजरीवाल को नैतिकता के आधार पर अपने पद पर बने रहने का कोई अधिकार नहीं है।
