Passage of Waqf Amendment Act 2025 by Lok Sabha is Highly Condemnable and a Direct Assault on Religious Freedom and Constitutional Rights: Syed Sadatullah Husaini

New Delhi : Syed Sadatullah Husaini, President of Jamaat-e-Islami Hind (JIH), has strongly condemned the passage of the Waqf Amendment Act 2025 in the Lok Sabha, calling it a blatant attack on religious freedom and constitutional rights.
In a statement to the media, the JIH President said: “The passage of this Act is highly condemnable and a direct assault on religious freedom and constitutional rights in the country. The law is discriminatory, as it erodes the autonomy of Muslims in managing their religious endowments, while religious trusts of other communities remain unaffected. The Act introduces sweeping changes to the Waqf Act 1995, drastically increasing government interference in the management of Waqf properties. This undermines Article 26 of the Constitution, which guarantees religious minorities the right to manage their own religious institutions.”
He expressed deep concern over the misleading arguments presented by treasury members during the parliamentary debate. Clarifying a major misconception, he stated that Waqf Boards are not equivalent to the Charity Commissioner, as falsely claimed in the Lok Sabha. He further pointed out that several states have exclusive legislations for Hindu and Sikh endowments, ensuring that regulatory and supervisory authorities belong exclusively to the respective religious communities .
Addressing the purported justification for the Act, he said: “The government has repeatedly cited mismanagement, legal disputes, and misappropriation of Waqf properties as reasons for this amendment. However, the Act contains no concrete measures to address these issues. Instead, adding non-Muslim members and shifting control to government-designated officers will do nothing to solve the problem. In fact, undue political and bureaucratic interference has historically been the primary source of corruption and mismanagement in Waqf affairs.”
He also criticized provisions such as altering ‘Waqf by User’ and imposing restrictive conditions on new Waqfs , calling them deliberate attempts to weaken Muslim institutions.
Expressing his deep disappointment with political parties that claim to uphold secularism yet supported this unconstitutional law , Syed Sadatullah Husaini said:“This hypocrisy will go down in history as the worst example of political opportunism and deception. We urge opposition leaders, secular forces, and legal experts to challenge this Act, which violates Articles 14, 25, 26, and 29 of the Constitution.”

He extended full support to the nationwide protests declared by the All India Muslim Personal Law Board (AIMPLB) and other Muslim organizations , emphasizing that: “All legal, constitutional, and democratic means will be pursued to overturn this unjust and unconstitutional law.”

نئی دہلی: ’’وقف ترمیمی بل 2025 کا شیدید مخالفت کے باوجود لوک سبھا سے منظور کیا جانا، مذہبی ازادی اور آئینی حقوق پر کھلا حملہ ہے‘‘ امیر جماعت اسلامی ہند، سید سعادت اللہ حسینی نے میڈیا کو جاری اپنے ایک بیان میں کہا کہ “مرکزی حکومت کا یہ فیصلہ انتہائی قابل مذمت اور بد نیتی پر مبنی ہے۔ یہ بل امتیاز اور مذہبی تفریق کی بدترین مثال ہے، اس بل کے ذریعے مسلمانوں کو اوقاف کا انتظام کرنے کے مذہبی و دستوری حقِ سے محروم کرنے کی کوشش کی جارہی ہے جبکہ دیگر مذہبی طبقات کو اپنے مذہبی مقامات کے مکمل انتظام و انصرام کا حق حاصل ہے ۔ اس ترمیم کے نتیجے میں وقف املاک کے انتظام میں سرکاری مداخلت بہت زیادہ بڑھ جائے گی جوکہ آئین کی ذفعہ 26 کے خلاف ہے جس میں مذہبی اقلیتوں کو اپنے مذہبی اداروں کو چلانے کے حق کی ضمانت دی گئی ہے‘‘۔
امیر جماعت نے مزید کہا کہ ’’ ہم اس بات کا اعادہ کرتے ہیں کہ وقف جائیدادیں مذہبی اوقاف ہیں ، ریاستی اثاثہ نہیں ۔ رہا یہ دعویٰ کہ ’’ مسلمانوں کو وقف ایکٹ کے تحت خصوصی حقوق حاصل ہیں ‘‘ سراسر غلط ہے۔ وقف ایکٹ 1995 اور 2013 میں مسلمانوں کو اوقاف کے حوالے سے ویسے ہی حقوق عطا کیے گئے تھے جیسے دیگر قوانین کے تحت دیگرمذہبی طبقات کو دیے گئے ہیں ۔ پارلیمانی بحث کے دوران پیش کیے گئے گمراہ کن دلائل پر گہری تشویش کا اظہار کرتے ہوئے امیر جماعت نے کہا کہ وقف بورڈ کی نوعیت چیریٹی کمشنر کی طرح نہیں ہے جیسا کہ لوک سبھا کے بعض ارکان کے ذریعے دعویٰ کیا گیا ہے۔ انہوں نے مزید نشاندہی کی کہ متعدد ریاستوں میں ہندو اور سکھ اوقاف کے لیے خصوصی قوانین موجود ہیں۔
محترم امیر جماعت نے مزید کہا کہ ’’ وقف بورڈ کی ساخت میں جبراً تبدیلی کرکے اس کے اراکین میں غیر مسلم افرادکو شامل کرنے کا فیصلہ، دراصل مسلم کمیونٹی سے ان کے مذہبی و فلاحی اثاثوں کا انتظامی حق چھیننے کے ارادے سے کیا گیا ہے۔ یہ ایکٹ سرکاری حکام کو وقف معاملوں میں مداخلت کرنے کا حق دیتا ہے، جس سے حکام کے لیے من مانے ڈھنگ سے وقف جائیدادوں پر قبضہ کرنے کا راستہ آسان ہو سکتا ہے جو کہ اوقاف کے وجود کے لیے خطرے کا باعث بنے گا۔ اس ترمیم کی وجہ سے سرکار، وقف جائیدادوں پر قبضہ کر سکتی ہے۔ اس بل کے ذریعہ مسلم کمیونٹی کو ان کے جائز ملکیتی اثاثوں سے محروم کرنے کا راستہ صاف کردیا گیا ہے جس کی زد میں متعدد عبادت گاہیں، اسکول ، کالج اور قبرستان آ جائیں گے۔ وقف بائے یوزر میں تبدیلی اور نئے اوقاف کے لیے سخت شرطوں کے اضافے سے صاف طور پر واضح ہوتا ہے کہ مسلم اداروں کو منظم طریقے پر کمزور کرنے کی پوری کوشش کی جارہی ہے۔‘‘
جماعت اسلامی ہند کے امیر سید سعادت اللہ حسینی نے ان سیاسی پارٹیوں کے تئیں مایوسی اور تأسف کا اظہار کیا جو سیکولرزم اور غیر جانبداریت کا دعویٰ کرنے کے باوجود اس بل کی حمایت کرتی رہیں۔ انہوں نے کہا کہ ہم اپوزیشن لیڈروں، سیکولر طاقتوں اور قانونی ماہرین سے پُر زور اپیل کرتے ہیں کہ وہ اس ایکٹ کو چیلنج کریں۔ یہ بل آئین کی دفعہ 14، 25، 26 اور 29 کے سراسر خلاف ہے۔ ہم آل انڈیا مسلم پرسنل لا بورڈ اور دیگر مسلم تنظیموں کے ساتھ مل کر اس جابرانہ قانون کے خلاف ملک گیر احتجاج کی حمایت کریں گے اور اس غیر منصفانہ و غیر آئینی قانون کو ختم کرنے کے لیے تمام قانونی، آئینی اور جمہوری طریقے اپنائیں گے۔
